Administrative Law (TOL210)

Administrative law is a legal course that provides knowledge about key rules that apply to administration (state, municipality and county authority). It begins with an introduction to constitutional law. Central to the course is an overview of what administrative activities are, and which administrative procedure rules apply to the different types of activities. The course also provides knowledge about the rights one has in relation to the administration. Particular focus is placed on customs administration rules.

Content

Administrative law regulates organization, responsibilities and decision-making competence in the public administration, and the rights and duties citizens have towards the administration. The course starts with an introduction to constitutional law, i.e. basic rules about our three state powers, their tasks, their legal relationship with each other and their competence vis-à-vis individuals and other private actors.

Administrative law contains general rules that apply to the entire public administration - this field is also called general administrative law. Administrative law course primarily aims to provide students with detailed knowledge of the rules on administrative proceedings laid down in the Administrative Law.

The course also deals with rules on customs administration, including the Customs Agency's special case-handling rules in the Transport of Goods Act, Chapters 7 and 13 and the Customs Duty Act, Chapters 8 and 11, other authorities' duty to provide information, duty of confidentiality, duty to notify and provide information to the customs authorities, as well as special case-handling rules in cases related to trade measures.

Learning outcome

After completing the course, the student will achieve the following learning outcomes defined in terms of knowledge, skills and general competence:

After completing the course, the student will have:

  • knowledge of the main features of the Norway’s state constitution
  • knowledge of administrative activities and the administrative apparatus
  • knowledge of the requirement for legal certainty in administration
  • knowledge of the rules on organization, responsibilities and decision-making competence in the public administration
  • knowledge of the rights and duties citizens have towards the administration
  • knowledge of the rules on administrative proceedings
  • knowledge of special procedural rules in the Transport of Goods Act, Chapters 7 and 13 and the Customs Duty Act, Chapters 8 and 11
  • some knowledge of the administration's competence, especially the principle of legality

After completing the course, students should have the following skills:

  • identify and discuss legal issues in constitutional law
  • apply the administrative procedural rules
  • analyze and discuss the principles that apply in administrative law
  • explain the structure of state and municipal administration
  • demonstrate knowledge of special customs administration rules

After completing the course, students must have general competence in:

  • how different cases are to be handled by the public administration
  • how to apply basic principles of administrative law to relevant issues in administrative law
  • planning and execution of varied tasks and projects that extend over time, alone and as a participant in a group, and in line with ethical requirements and guidelines
  • the procedural administrative law

1 Assignment
One compulsory assignment must be approved in order to take the exam. The assignment can be of a theoretical or practical character. The assignment can furthermore be organized as a group submission. Method of work

The course is a full time study. Forms of teaching are varied and include lectures, seminars and one compulsory assignment. Students are expected to work independently and it is assumed that the students come prepared for the lessons.

Course assessment

There must be an early dialogue between the course supervisor, the student union representative and the students. The purpose is feedback from the students for changes and adjustments in the course for the current semester.In addition, a digital subject evaluation must be carried out at least every three years. Its purpose is to gather the students experiences with the course.
